Is collaborative divorce an alternative to divorce mediation?

In Rhode Island, a number of divorces are fought over and finalized every year. And while some of these separations are amicable, others involve lengthy court-room battles. But, no matter what method of divorce is used, the emotional stress on the spouses may often become too much to bear.

There are various methods that a couple can use during a divorce and divorce mediation has always been a preferred choice among many couples. This is mainly because of the monetary savings that the couple may realize during the lengthy litigation process. Lately, however, a new type of divorce is garnering a lot of attention in states other than Rhode Island. This type is known as a "collaborative divorce."

In a collaborative divorce, like mediation, a court does not play any role in the outcome of the divorce, other than ensuring its conforming to the law. It is the separating couple that is involved in all decision-making pertaining to the separation with necessary guidance from legal professionals. It encourages a free exchange of ideas and information and makes a conscious effort to respect the shared goals of both parties.

Besides the monetary savings a mediation or a collaborative divorce can bring, a couple can often expect a speedy resolution of the problems, and as a result, a speedy divorce and a reduction of stresson the participants. 

This process is similar to a divorce mediation process in many ways, and comes with some advantages. However, because of the popularity of mediation in Rhode Island, collaborative divorce has not taken hold here.  

Therefore, if a couple from Rhode Island, are contemplating a divorce, and are unsure about the type of divorce process that they should opt for, they should understand that mediation is less expensive, quicker and private.
