When might sole child custody be appropriate in Rhode Island?

Last week this blog discussed various aspects of successful co-parenting after divorce. However, there are situations in which Rhode Island couples may find that joint custody is not in the best interests of their child. When this is the case, one parent may be awarded sole custody of the child.

In what types of situations might sole custody be appropriate in Rhode Island? One situation, of course, is when there is instances of domestic violence or child abuse on the part of one parent. When this is the case, the parent who is not the perpetrator of the violence may be awarded sole custody. Children should not be placed in a situation that endangers their safety.

Another situation in which sole custody might be appropriate in Rhode Island is if one parent abuses alcohol or drugs. A third situation in which sole custody might be appropriate is if one parent suffers from a mental illness that prevents that parent from making appropriate decisions with regards to raising a healthy child or that prevents that parent from being able to communicate in an appropriate manner. Finally, sometimes a child's parents' relationship is so toxic that they simply cannot communicate without fighting.

If a parent in Rhode Island wants to seek sole custody of his or her child, he or she may benefit from seeking legal advice. An attorney can help a parent determine if joint custody or sole custody is in the child's best interests. An attorney can also advocate for a parent, and can educate a parent about child custody laws in Rhode Island. Parents who want to learn more about child custody in the state may benefit from viewing the child custody website of the Law Office of Steven J. Hirsch, Esq.
