Address finances before marriage via a prenuptial agreement

Drafting a prenuptial agreement does not mean that you expect to divorce. Quite the contrary, it can serve as a means to discuss finances openly and honestly which in the end could lead to a stronger marriage. That being said, it is a fact that many marriages in Rhode Island these days, despite the best efforts of both parties, end in divorce.

Prenuptial agreements, properly drafted and executed, are legally binding documents. They can protect not only the financial interests of the soon-to-be spouses but also the financial interests of any children a spouse may have from a prior marriage. With a prenup, there are less likely to be financial secrets between spouses. Prenups also give couples a plan for managing their finances and assets while wed. And should a couple not draft a prenup before getting married, Rhode Island law allows them to enter into a postnuptial agreement that covers very much the same issues as a prenup.

With a prenup in place, should a couple in Rhode Island divorce, issues regarding the division of marital and premarital property, such as gifts and inheritances, will already be decided upon. This can make the divorce process run more smoothly, which could give couples peace of mind.

However, whether you are drafting a prenup or trying to enforce one, it is important to have a legal advocate at your side. Family law attorney Steven J. Hirsch, Esq., has practiced law for over three decades. He helps his clients understand their legal options so that they can make informed decisions. His webpage on prenuptial agreements may be of use to couples who are either heading down the aisle or heading towards divorce.
